By accessing or using NEMENU, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

NEMENU provides a platform for restaurants to create, manage, and share digital menus. We reserve the right to modify or discontinue any aspect of the service at any time.

3. Cookie Requirement

To use NEMENU, you must accept our use of cookies, including analytics and marketing cookies. These cookies are essential for us to provide, improve, and secure our service. If you do not accept cookies, you will not be able to access or use the NEMENU platform. For details on the cookies we use, please see our Cookie Policy.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account.

5. Account Deletion

You can delete your account from your account settings, or by emailing hello@nemenu.app. Your menu goes offline immediately, and your account can be restored for 1 year before it is permanently removed. If you want it erased sooner, use the “Permanently delete now” option on the restore screen or ask us by email and we will erase it without waiting.

6. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Upload content that infringes on intellectual property rights
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use the service to distribute spam or malware

7. Tenant-Installed Integrations

Pro and Enterprise plans allow you to install third-party tracking pixels (Meta, TikTok, Google, Pinterest, LinkedIn, Snap) on your public menu page. By enabling any pixel, you confirm and agree that:

• You are the data controller for any data collected by these pixels under GDPR and equivalent laws.
• You are solely responsible for compliance with applicable privacy and data-protection laws — including disclosure in your own privacy policy, lawful basis under GDPR, and honoring opt-out requests from menu visitors.
• You must only paste pixel IDs that belong to accounts you control or are authorized to use.
• NEMENU provides only the technical integration; we do not collect or use the data your pixels send to third parties.
• Visitors to your menu will see a cookie banner with Accept / Decline; pixels load only on Accept.

We may suspend tracking pixels for accounts that misuse this feature, including but not limited to attempting to track minors, breaching third-party platform policies, or violating applicable law.

8. Content Ownership

You retain ownership of the content you create on NEMENU. By using our service, you grant us a license to display and distribute your content as necessary to provide the service.

9. Payment Terms

Paid subscriptions are billed in advance on a monthly basis. You may cancel your subscription at any time. Refunds are available within 14 days of purchase for established food service businesses (restaurants, bars, bakeries, cafes, and similar establishments) as per our money-back guarantee.

10. Limitation of Liability

NEMENU is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.

11. Changes to Terms

We may update these terms from time to time. We will notify you of any significant changes by posting the new terms on this page.
